Hello Within, few hours of my publishing an article on my web site blog, its being stolen by another blog. The other bog does not have any contact info, looks like its using the stolen material for google adsence adds. They have many articles copied form my site.

What can I do to?
i) have it removed from the site copying
ii) how can I prevent this in future from happening.

I am new startup & don't have the time & resources to get into legal proceedings...

My blog site is WWW(dot)medicaltourismco(dot)com/medical-tourism/

if u put search for 9 Bandster Eating Rules: Gastric Lap Band Diet Recommendations in the google search u will see mine on top, and somewhere on the same page the copied one.

well when I put that in on G! I find three entries, all on the last page (no. 4) right at the bottom...

It sounds like your site may be being scraped. I used to work for a major online job board that scraped other boards - displaying their jobs as if it was our own. It is dubious but the directors knew that it was difficult to get around it legally... so continued the practice. If large publicly-traded corporations can't get around this legally - it seems like a lone blogger wouldn't either. This Wikipedia article has some ideas on blocking scrapers technically:

I am not very technical myself, so I can't comment on the validity of the methods described. But - I think that you are better to go with technical rather than legal means of blocking the scrapers.

The last one is copied form my site. The first two are mine So What can I do to?

i) have it removed from the site copying (there are others ones copied from me as well)

have you approached them asking them to remove the content?

does the content rerfer to your site, with appropriate credits and hyperlink, so might be doing your site some good?

How are they pulling in the content? Are they scraping it from your RSS feed - if so, put a link back to your website on all of your RSS entries.

There is no way to contact them, I tried their website to find contact info could not. Also, the domain is a subdomain one, not sure how to get a contact

Good idea Katy. If you're getting some linking benefit and they're not showing up instead of your site then it may be worth leaving it alone.

Alternatively, there are things you can do about this. I had a look into the parent domain and that seems pretty spammy too, but it could be worth writing to them and explaining that someone using a one of their subdomains is doing this and you're not happy about it. They may simply want to avoid any potential for legal action and may just stop it at the first request.

Alternatively (or even as well) you can contact Google citing the DCMA. I don't have any experience with this situation specifically, but as I understand it google will take any DCMA notice seriously and will remove any infringing pages from their index - I would assume the same is true for Yahoo, MSN, etc.

1. File the DMCA complaint with Google etal as Rolf suggested above.

2. If you cannot find any contact information on the domain or subdomain itself, look up who owns the domain in the Whois records. It'll provide contact information for the domain owner. It's quite possible the domain owner may not even know what's happening on a subdomain, but they should deal with it eitherway. If you need a Whois tool to use, I've got a little one on my personal site that will look up .org's and every other tld known to man.

3. If that doesn't get ya any response go to whoever is hosting the domain. To do this you need to figure out the IP number the site is sitting on. You can get this info one of several ways, the most common being a tracert domain.com from the Windows command prompt. (FYI, the IP in this case is 72.5.54.38) Then file a copyright infringement complaint directly with the host. They generally don't fool around and will simply take the offending site offline since copyright violations are always a part of any hosts TOS.

Look up that IP number in a Whois tool that supports IP lookups (mine above does) to figure out who the host is. In this case it's InterNap, who in my experience are very responsive to abuse and/or copyright infringement complaints.
