Just because it's free, that doesn't mean it isn't commercial. If you're trying to sell something on that site, it looks pretty commercial.
Google does have a process for approving commercial applications that use the API. Personally, I'd rather just have a way to pay them for running queries, with or without the API.

Agreed... although we aren't selling anything to do with search engine optimization or anything website or content related. But the tool *is* hosted on a domain that is used for commercial purposes. We are in the process of spinning it off into it's own domain. And we have also started the process for getting "commercialization" authorization from Google. Although that part is just a technicality since it will always remain free.
