I think I'm missing something here. What do you mean by "have they been penalised"? Have who been penalised? And what is a "3rd party website"?

Google's Chrome Page No Longer Ranks For Browser After Sponsored Post Penalty
They've been penalized for asking people to write sponsored articles about them and having a link point to them from one of the sponsored articles.
What they should have been penalized for, however, was paying to have low quality garbage content added online which would potentially help them rank better from Chrome and browser keyword phrases.

So they have not been penalised for having a link on a site its because it's been paid for?

Exactly. It's not against any guidelines for sites to link to other sites. Only to pay for sites to link to you.
