Yes. Because it is. Two distinct url addresses with the same exact content is duplicate by its very definition.

No. There is no such thing as a Duplicate Content Penalty for a situation like you describe. It's a filter, not a penalty.
As far as a fix goes, which is really more to get the link pop/PR to pass to the correct url address than anything else, you'd need to detect the affiliate id, record whatever data you need to record, then have a scripted 301 redirect back to the base url address without the affiliate id info. Be very careful you're saving all of the affiliate data you need though. If you don't you'll end up having a lot of ticked off affiliates. With good reason.

Yes, because that's what it is. The same content appearing on 2 different URLs.

There are solutions that get around this situation and use a direct link. Two that I'm sure do that are idevaffiliate and PAP
There can be extra charges for this 'plug in'
There are other options that allow mod rewrite etc also.
I cannot vouch personally for the software linked to but they seem quite comprehensive and good value to merchants.
