Depending on the site you might be able to use the noframes tag to work some copy into a page that no one ever really sees.

you have a point but make it like a real page would be if there were problems recognising frames and surley you are in the clear?

I guess if your only goal is to be "in the clear" it might work for a time.

It's still search engine spam, however.

I think the statement that the product pages aren't getting spidered is a big issue you should try to resolve quickly. I'd suspect the navigation is using javascript or some other method that is preventing the spiders from following. But even if you resolved this, do the product pages contain good content or are they insistent on having 'clean' no-text product pages too? If that's the case, then I guess it wouldn't matter whether the nav allowed spidering anyway, you really can't optimize a page without content to optimize, so your client is essentially shooting their self in the foot in order to maintain their pretty site.

If they won't allow text on the homepage, and you can't control alt text, etc, then you need to tell them it can't be optimized as there is nothing there to optimize. Same goes for product pages ... no text, no optimization possible. Though I agree with Jill that the client needs educating, if they insist on this approach, then there is little you can do. for their existing pages.

I'd really consider creating new additional pages that can be optimized, and try to get those to rank. If you manage to show that text rich pages will do much better in the SE's than their image-only pages, then maybe they'll get the clue. My thought would be to create a 'more info' page for each product, and use a simple non-javascript link from each product page (once you get the nav working) to the appropriate 'more info' page. This wouldn't 'ruin' their design, but supplement it, and these pages would be spiderable and have good potential to rank.
