Some differentiate between SEO --Optimization, which in their view is all about search engines-- and SEM --Marketing, which in their view is for real people.

I don't. You don't. But some do.

Depends on the definition of a penalty. Penalty as in being removed or penalty as in those links just not counting?

I would recommend crosslinking similar sites provided it's done in a way that's beneficial to all involved - you, your visitors and search engines. Do you have to link on every single page? Can the cross linked sites go on a resource page and have descriptive text added making it easy to understand why you're linking?

Do the cross linked sites have unique inbounds? Do they have to link to each other in footer links or can the links be done to internal pages from internal pages?

I think cross linking is about smart navigation more than anything else.
